WESA Primer + BC Estate Case Law Update
The estate planning and administration process is becoming more complex in British Columbia due to a number of key drivers and trends. These include: the increased value of estates in BC, managing complex, multi-generational and multi-jurisdictional estates, evolving regulation and increased disputes surrounding estates. It also includes ongoing changes to WESA - BC’s Wills, Estates and Succession Act.
To help bring these drivers and trends to life, our presenter will review examples of some high profile estate matters in BC in recent years. How these specific matters reflect the drivers and trends noted above. And what changes to WESA are most relevant to estates professionals in their practices.

Estate planning in the digital age
In the midst of the greatest intergenerational wealth transfer in history, software and digitization is impacting every space, including estate planning.
In estate planning - increasing digitization has two key elements. The first is how the estate planning process itself is being transformed by technology. And how forward thinking advisors are leveraging it to deliver better results for their clients and gain competitive advantage.
The second is the emergence of digital assets - for example cryptocurrencies - which add a new dimension to the estate planning process. As digital assets grow in popularity - and form a greater share of clients assets - the future impact on the estate planning process is palpable.
In this session, our speakers will look at the contemporary drivers and trends when it comes to digitization and the estate planning process as well as how to develop a strategy to manage digital assets.
During the session, our speakers will review the following themes:
How is the estate planning process going digital and what are the benefits for estate planning professionals?
What role do professionals play in managing the estate planning process digitally? What risks do advisors and their clients face if they are not digitizing their practices?
What are digital assets and what are the key areas related to them that professionals need to be aware of?
What platforms are available to professionals to assist with making this process more efficient and help enable value added solutions to be offered to their clients?

The evolving family: addressing challenges in the estate administration process
The increasing complexity of estates is reflective of how society is evolving as well. Families who are the beneficiaries of estates are often blended, multi-jurisdictional and multi-generational. This creates different drivers, requirements and expectations from stakeholders during the estate administration process. Adding to the mix, as digitization across society and business accelerates, so do expectations for a digitized estate administration experience. However, for end users – coordination, planning and execution during the estate administration process is often seen as opaque, slow and traditionally analogue.
In this session, our speakers will review the impact of the evolving complexity of families on the estate administration process. And how emerging digital and financial platforms are helping to simplify the estate administration process.
Themes covered will include:
How are evolving family structures impacting the estate administration process? And what are the key drivers and trends surrounding this (i.e. blended families, definitions of spouse and multi-jurisdictional estates)?
Disputes. How are disputes concerning estates evolving and what are the key trends surrounding them? And how are disputes being resolved both within and outside the courts?
Innovation and the estate administration process. How are emerging digital platforms and financial solutions helping to smooth what is a slow and opaque process for beneficiaries?
Speakers:

Stephen Pauwels, Co-Founder + Partner, Bridgepoint Financial
Peter Schmidt, Partner, BTM Lawyers

How to manage estates with an active business involved
A common issue faced by estates professionals is when a business that is a going concern forms part of an estate. During the estate administration process how a business is transferred, unwound or sold off is a complex process. Issues around business management and corporate structure, tax, employment law, valuations and disputes (as well as others) all play key roles.
During this session, our speakers will review the key areas (and risks) to be aware of when an estate has a going concern business as part of them. How to develop a plan to address them and collaborate with other professionals effectively. And how to execute on these strategies successfully.
